TAMPA, Fla. (Legal Newsline) - Parents of a 17-year-old daughter who worked at a Florida Wendy's say her wrongful firing caused her to be missing for five days.
In an April 26 lawsuit filed in Hillsborough County Circuit Court, D.B. and S.B., as individuals and parents of M.B., a minor, sued The Wendy's Company, Wendy's International LLC, and Jamaya Jauvoris Clemmons.
The plaintiffs allege that their minor daughter was subjected to unwelcome sexual advances by Clemmons while working at a Wendy's restaurant owned by the defendants.
The complaint states that from October to December 2023, Clemmons made explicit comments about M.B.'s appearance and violated her personal boundaries in an attempt to establish a sexual relationship with her.
In December 2023, M.B. was allegedly berated by a senior management representative of The Wendy's Company regarding an alleged "sexually inappropriate" incident involving her and Clemmons. Following this confrontation, M.B. was either directly or constructively terminated from her position.
"Directly as a result of M.B.'s interaction with management from Wendy's, M.B. went missing for five days," the suit says.
Among the claims for relief are negligence, intentional infliction of emotional distress, interference with a parent-child relationship, sexual harassment and hostile work environment.
