BOSTON (Legal Newsline) - Plaintiffs fed up with spam emails are suing one of the senders in Massachusetts state court.
Several individuals including Brinda Moorehave on April 25 filed a complaint in Suffolk County Superior Court against Fight Age Labs LLC and other entities for violation of California's Anti-Spam Law.
The defendants include Phytage Labs LLC, Pinnacle Health Brands LLC, Bethany Chan, City109.com, Growth Loop LLC, Revealed Films Inc., Haven Vasquez and Warrior Media Inc.
The plaintiffs allege that they received at least 156 unsolicited commercial emails promoting Fight Age and its various websites selling health products.
The California law under which they use provides for damages of $1,000 per spam, they say, and a prevailing spam recipient can recover attorneys fees from the defendant.
Daniel Balsam and Jacob Harker in California represent the plaintiffs, along with James Knudsen of Knudsen Burbridge in Wakefield.
