Wrongful death case says window in apartment gave way, leading to fatal fall

BOSTON (Legal Newsline) - The owner of a Boston apartment building faces a lawsuit over the death of a man who fell out of a second-story window.

Erika Moon, both individually and as a representative of the estate of Isaak Moon, filed a lawsuit April 17 in Suffolk County Superior Court against Hildebrand Family Self-Help Center, Inc., and 12 American Legion, LLC. 

Moon's legal counsel is Nicholas Brown of Morgan & Morgan. The suit alleges that the defendants owned, managed, and maintained the premises where Isaak Moon died after falling from an improperly secured window. 

According to the complaint, Moon had reported this safety issue several times prior to the incident. He was opening the window when the incident occurred.

The plaintiff accuses the defendants of negligence for failing to maintain safe conditions at their property, failing to warn about known hazards, not erecting safeguards or remedying known unsafe conditions, and not complying with governmental codes and regulations.
