America First Legal’s lawsuit against the U.S. Department of Health and Human Services (HHS) has brought to light documents revealing a radical plan to transform healthcare based on the principle that gender is "multidimensional," not biological. The plan, led by Assistant Secretary of Health "Rachel" Levine, aims to change governmental data and statistics on sex in the name of "gender identity."

In an email dated April 27, 2022, Assistant Secretary Levine expressed full support for recommendations from the National Academies of Sciences, Engineering, and Medicine on "Measuring Sex, Gender Identity, and Sexual Orientation," which were funded by 19 entities within the National Institutes of Health (NIH). The presentation, paid for by taxpayer dollars, includes definitions of sex, gender, and various gender identities, advocating for a shift away from biological sex as a primary identifier.

The presentation asserts that "better measurements of sex, gender identity, and sexual orientation will improve the ability to identify sexual and gender minority populations." It goes on to define sex and gender as multidimensional constructs, separate from each other, and introduces a range of gender identities and sexual orientation identities. The recommendation is made to collect data on gender and report it by default, disregarding biological sex, and differentiating between sex on one's birth certificate and current gender.

Ian Prior, Senior Advisor at America First Legal, criticized the Biden administration's approach, stating, "Americans should not be footing the bill for delusional attempts to make up words and rewrite the laws of biology." He expressed concern over the administration's push for a radical gender ideology through the National Institute of Health, funded by taxpayers, and emphasized the need to halt what he referred to as a "bad science fiction novel."

The presentation's content and the administration's actions have raised alarms about the prioritization of gender ideology over scientific facts within the nation's health apparatus. The implications of this radical approach on policy decisions and healthcare provision for all Americans are significant, highlighting the ongoing battle between biological reality and ideological agendas at the highest levels of the federal government.
