BOSTON (Legal Newsline) - A lawsuit against a dumpster company alleges one of its trucks struck and dragged a cyclist in Boston, killing him.
K-Town Disposal, LLC and an individual identified as John Doe are facing a lawsuit filed by Hilary Clemmer, the personal representative of the estate of George L. Clemmer, II. The case was filed March 28 in Suffolk County Superior Court.
The complaint alleges that on July 18, 2022, George L. Clemmer II was riding his bicycle on Massachusetts Avenue in Boston when he was struck by a vehicle operated by John Doe and owned or controlled by K-Town Disposal.
The incident resulted in severe bodily injuries to Mr. Clemmer, who was subsequently dragged down Huntington Avenue by the vehicle. The vehicle then backed over Clemmer, causing further injuries which led to his death, the suit says.
The plaintiff claims that the collision was caused by the carelessness and gross negligence of John Doe, who was acting as an agent or employee of K-Town Disposal at the time of the incident. As such, K-Town Disposal is allegedly vicariously liable for John Doe's alleged negligence.
The lawsuit seeks damages for severe bodily injuries, conscious pain and suffering, loss of earning capacity, medical expenses incurred prior to Mr. Clemmer's death and wrongful death.
