TALLAHASSEE, Fla.—Attorney General Ashley Moody, along with a coalition of five other state attorneys general, has filed a lawsuit against the Biden administration’s latest student loan plan, labeling it as an attempt to burden Americans with someone else's debt.
In a statement, Attorney General Moody criticized the Biden administration, stating, “Last year, the Supreme Court struck down Biden’s illegal attempt to force Americans to pay off someone else’s debt. Now, Biden thumbs his nose at the court like he has done with so many issues, including immigration, and does what he wants, trying again to mass-cancel student debt. We will fight in court to make sure that hard-working Americans, who are struggling to buy groceries thanks to Biden, are not on the hook for other people’s debt.”
The lawsuit, led by Attorney General Moody and the coalition of attorneys general, challenges the legality of the Biden administration's "SAVE" Plan, which is projected to cost Americans $475 billion. The attorneys argue that the President is attempting to implement a costly and controversial policy without the consent of Congress, in a move that circumvents the Constitution.
Highlighting the Supreme Court's previous ruling against a similar attempt by the Biden administration, the attorneys general emphasize the unconstitutionality of the massive wealth transfer involved in the student loan plan. The Supreme Court's decision, cited in the lawsuit, deemed Biden’s repayment plan as unconstitutional due to its significant impact on the federal budget without proper authorization from Congress.
