WEST PALM BEACH, Fla. (Legal Newsline) - A Florida detox center faces litigation after a resident allegedly obtained the drugs that led to his fatal overdose.

A wrongful death lawsuit was filed March 15 in Palm Beach County Circuit Court against Aloha Detox Center, LLC, a Florida-based company. The plaintiff, Cheryl Feinman, is representing the estate of her deceased son, Zachary Feinman.

The complaint alleges that Zachary died due to negligence and violation of statutory duties by the detox center.

Zachary was admitted to Aloha Detox Center on June 9, 2023, for treatment related to his addiction to controlled substances. However, he was found unresponsive later that day and pronounced dead at Delray Medical Center.

The Palm Beach County Medical Examiner determined the cause of death as Acute Combined Drug Toxicity (Acetyl fentanyl, Fluor fentanyl and Fentanyl).

The lawsuit claims that while in the care of Aloha Detox Center, Zachary was allowed access to drugs such as Acetyl fentanyl, Fluor fentanyl and Fentanyl which were not part of his detox program.

Attorney Joshua Frachtman of Zimmerman & Frachtman represents the plaintiff.
