Lawsuit says Northeastern student fell out of window at overcrowded sorority party

BOSTON (Legal Newsline) - A sorority and others faces a Massachusetts lawsuit after a student says she fell out of a second-floor kitchen window because too many people were at a party.

A lawsuit was filed March 12 against Marcia Ramos, Ramos Properties II, LLC, Phi Omega Chapter of Alpha Epsilon Phi Sorority, Incorporated, Margaret “Maggie” Scales, Alpha Epsilon Phi Sorority, Incorporated and an unidentified defendant (Doe #1) in the Superior Court of Suffolk County, Massachusetts. 

The plaintiffs in the case are Sarah Cox, Batul Kazim and William Cox. 

The lawsuit stems from an incident that occurred on March 31, 2023, at a sorority party hosted by the Phi Omega Chapter of Alpha Epsilon Phi Sorority at a property owned by Ramos Properties II and managed by Marcia Ramos. 

During the party, Sarah Cox fell out of a window from the second floor of the house onto the driveway below. She suffered catastrophic injuries as a result, the suit says.

Ramos should known the windows were installed so low that a person could "easily fall out of them," the suit says. The sorority also should have known there would be parties at the house during which more people than the house could accommodate would be drinking alcohol.

The plaintiffs allege negligence on part of all defendants and have requested for a jury trial. They are represented by James Kelly of Rubenstein Law.
