The Independent Investigations Division (IID) of the Maryland Office of the Attorney General released its investigative report of the June 21, 2022, police involved fatal vehicle crash in Baltimore City.
On June 21, 2022, at approximately 12:40 p.m. Baltimore City Police Officer Alexis Acosta was driving a marked BPD cruiser along the 2400 Block of E. Biddle Street with lights and sirens activated as he responded to an officer assistance call. When he entered the intersection of E. Biddle Street and N. Milton Avenue, the BPD cruiser collided with a scooter. The driver of the scooter, Terry Harrell, was taken to an area hospital with serious injuries. Mr. Harrell died from his injuries on June 23, 2022. Officer Acosta was not injured. The IID concluded its investigation on February 19, 2023, and forwarded its report to the Baltimore City State’s Attorney’s Office on March 2, 2023. On May 4, 2023, the Baltimore City State’s Attorney’s Office announced that a grand jury indicted Officer Acosta for manslaughter, reckless driving, negligent driving, failure to control speed to avoid a collision, death of a vulnerable individual caused by motor vehicle, and driving an emergency vehicle without regard for safety of persons.
On January 16, 2024, Officer Acosta pleaded guilty to vehicular manslaughter and was sentenced to three years, all suspended, and two years of supervised probation. The IID’s report contains detailed investigative findings and an analysis of relevant legal issues. Because the Baltimore City State’s Attorney’s Office—not the IID—retains prosecution authority[1] in this case, the report does not make any recommendations as to whether any individual should or should not be charged.
