Hammond Grinding and Recycling Indicted for Falsifying Annual Facility Reports

Attorney General John M. Formella announces the indictment of Hammond Grinding and Recycling Inc. a/k/a F.C. Hammond & Son Lumber Co. (“Hammond”) of Orange, in Grafton County for six felony counts of Solid Waste Facility Violations in violation of RSA 149-M.

The Grafton County Grand Jury has returned indictments for six class B felony charges of Solid Waste Facility Violations. Three indictments allege that between March 30, 2020, and March 22, 2023, Hammond failed to report to the New Hampshire Department of Environmental Services that they exceeded their permit capacity for unprocessed construction and demolition debris. The remaining three indictments allege that on March 22, 2023, March 18, 2022, and March 11, 2021, Hammond submitted an annual facility report with false quantities of waste received by the facility and a false representation that they were in compliance with the terms of their permit.

If convicted, Hammond faces up to a $25,000 fine on each felony charge. Hammond is scheduled to be arraigned on the charges in the Grafton County Superior Court on February 20, 2024, at 9:00 a.m.The charges and allegations are accusations, and Hammond is presumed innocent unless and until proven guilty.This case was investigated by Department of Environmental Services –Solid Waste Management Bureau and Investigator Jim Hodgdon of the New Hampshire Attorney General’s Office Criminal Bureau. The case is being prosecuted by Senior Assistant Attorney General K. Allen Brooks and Assistant Attorney General Melissa Fales of the Environmental Protection Bureau.
