AI and Bias in Hiring Promotion Practices on December 13, 2023

Employers within the U.S. are slowly implementing artificial intelligence (AI) tools to help make employment decisions. The use of AI has three objectives: First, AI can review thousands of applications in seconds, making the process more efficient; second, AI can help improve the quality of hires by identifying the best candidates, both internal and external, based on objective criteria; third, AI can remove human bias from the decision-making process, which can lead to unlawful discrimination and subsequent litigation. Regarding the third point, however, many fear that the use of AI may instead lead to the opposite, in that AI may exhibit the same biases as can be exhibited by humans.

In this webinar, we will first examine AI algorithmic hiring biases in the context of employment decisions, and then discuss historic regulation of employment selection procedures, and how that historic regulation would apply to using AI for employment decisions. We will also provide an overview of legislators’ and employers’ past and expected efforts to create a transparent and trustworthy framework for using AI in the employment context, including President Biden’s recently signed Executive Order on Safe, Secure, and Trustworthy AI.
