Woman says she was sterilized after giving birth

TAMPA, Fla. (Legal Newsline) — Health care entities face a lawsuit after a difficult birth.

Jhnae Sims filed a complaint Nov. 17 in Hillsborough Circuit Court against Galencare Inc., doing business as HCA Florida Brandon Hospital; Florida Hospital Physician Group Inc., doing business as Adventhealth Medical Group Obstetrics & Gynecology at Oakfield; and others, alleging negligence and other claims.

According to Sims' complaint, she gave birth to her baby through cesarean section on July 13, 2022, at HCA Brandon Hospital. She claims that during the cesarean section surgery, her spleen was lacerated twice and that the defendants failed to identify the source of her lacerations or hemorrhages. 

Sims alleges that that next morning, she had to be taken back into surgery and required several blood transfusions. She further alleges that during her second procedure, a total splenectomy was performed and that a sterilization procedure was performed without properly informing her and despite her bleeding not being caused by a uterine bleed. 

Sims seeks more than $50,000, interest and all other just relief. She is represented by Wesley Straw, Matthew Emerson and Nicole Ziegler of Emerson Straw PLC in St. Petersburg.
