Attorney General Ken Paxton Secures Administrative Stay to Preserve Texas Border Barriers

Texas Attorney General Ken Paxton has obtained an administrative stay that will prevent the federal government from destroying Texas's concertina wire fencing along the United States-Mexico border. The stay was granted by the Fifth Circuit, which has prohibited federal immigration officials from damaging the wire fences while the U.S. Department of Justice prepares a response to Texas's motion for an injunction pending appeal of the district court's order.

This administrative stay comes as part of Texas's ongoing lawsuit against the Biden Administration, in which the State seeks to prevent the federal government from cutting, destroying, damaging, or interfering with Texas's concertina wire border fence. Attorney General Paxton immediately appealed after a federal district court judge denied the State's efforts to enjoin the federal government.

Attorney General Paxton filed the lawsuit and a motion for preliminary injunction in October, targeting the Biden Administration's Department of Homeland Security (DHS), DHS Secretary Mayorkas, and other agencies and officials. The lawsuit was prompted by the destruction of Texas's concertina wire by federal agents, who allowed aliens into Texas on an almost daily basis for weeks. In response, Attorney General Paxton secured a temporary restraining order on an emergency basis to halt further destruction after federal agents escalated their actions.

In light of the administrative stay, Attorney General Paxton expressed satisfaction with the court's recognition of the federal government's attempts to undermine law and order at Texas's border. He stated, "This is an important step supporting Texas's right to protect our citizens from Biden's doctrine of open borders at any cost."

Texas, along with co-counsel the Texas Public Policy Foundation, is seeking to prevent the Biden Administration from destroying the state's wire fencing. The case remains ongoing, and the administrative stay will preserve the integrity of the border barriers while the legal proceedings continue.
