Disney sued over danger at the pool

LOS ANGELES (Legal Newsline) — Disney faces a rare slip-and-fall class action lawsuit.

Plaintiffs Scott and Danielle Thompson, individually and on behalf of all others similarly situated, filed a complaint Nov. 8 in the U.S. District Court for the Central District of California against The Walt Disney Company, alleging negligence, violation of the California Unfair Competition Law and other claims. 

The plaintiffs, according to their class action complaint, were guests at Disney's Aulani Resort Spa in Hawaii on March 19, 2023. They claim that after the Thompson children went down one of the slides, child A.T. was stepping out of the pool when he hit slipped and hit his head on the corner of the top step to the outside slides area. 

The plaintiffs allege A.T., who was 10 at the time, split his head open and required several stitches. They further allege Disney's negligence for its failure to ensure the pool deck is reasonably safe for visitors, including having anti-slip mats or tape in place. 

The plaintiffs also allege Disney falsely advertises the resort as safe and fails to disclose that guests need to use caution while exiting the pool. 

The plaintiffs seek monetary relief, trial by jury, interest and all other just relief. They are represented by Francis Flynn, Jr., of The Law Office of Francis J. Flynn, Jr., in Los Angeles.
