SAN FRANCISCO (Legal Newsline) — Nature's Path faces a class action lawsuit alleging it misrepresents the amount of protein in its products.

Ian Miller filed a complaint Nov. 6 in the U.S. District Court for the Northern District of California against Nature's Path Foods Inc., alleging false advertising, unjust enrichment, unfair business practices and other claims.

According to Miller's class action, the defendant - which manufacturers and sells breakfast and snack products, including "Nature's Path," "Envirokids" and "Love Crunch" - fails to include the percent of daily value in the product label's nutrition facts panel. 

He alleges that on the front label, the defendant claims a specific amount of protein but fails to give the specific amount of protein per serving. Miller alleges that health-conscious consumers reasonably expect the product to actually provide the amount of protein per serving that is claimed on the front label. 

He further alleges the defendant's failure to include the correct amount of protein does not comply with state and federal requirements and that consumers also pay a price premium for the products.  

Miller and the class seek monetary relief, interest, trial by jury and all other just relief. They are represented by Seth Safier, Marie McCrary, Hayley Reynolds and Kali Backer of Gutride Safier LLP in San Francisco.
