LAS VEGAS (Legal Newsline) — A California law firm has taken to Nevada federal court to be awarded fees it says another firm owes it.
Sky Law Group filed a complaint Oct. 2 in the U.S. District Court for the District of Nevada Las Vegas Division against Paul Padda Law PLLC and Darshpaul S. Padda, alleging breach of contract, deceptive trade practices and other claims.
The plaintiff alleges that it was retained in March of 2018 by California resident Patricia Excalera-Diaz, who was injured on a Holiday Inn Club Vacations shuttle bus while at the Desert Club Resort.
Sky Law claims it referred the case to Padda Law since it needed to be filed in Nevada and that they entered into a "consent to fee split" with Padda. The agreement, according to the suit, included the plaintiffs receiving 45% and Padda Law receiving 55% of fees. Sky Law Group alleges Padda failed to hold the settlement funds in the trust portion of the attorney's fees owed and told a representative from his firm that payment to Sky was delayed because Padda was trying to purchase a multimillion-dollar property.
Sky Law also alleges Padda now refuses to pay Sky attorney's fees required under the agreement.
Sky Law Group seeks monetary relief of more than $75,000, interest, trial by jury and all other just relief. It is represented by Dennis Kennedy and Joshua Gilmore of Bailey & Kennedy in Las Vegas.
