Parents sue daycare over 9-month-old's broken leg

HOT SPRINGS, Ark. (Legal Newsline) — An Arkansas lawsuit alleges staff at a daycare in Hot Springs allowed a 9-month-old child to be checked out by someone other than his parents, and that he was later found to have a broken leg.

Courtney and Dalton Staggs, individually and as parents and guardians of T.W.S., a minor, filed a complaint Oct. 13 in Garland County Circuit Court against Little Bitty City Daycare, doing business as Little Bitty City Enrichment Center (LBCEC), and others, alleging negligence, battery and other claims. 

The Staggses, according to their complaint, had their child at LBCEC. They claim that on Nov. 10, 2021, their son had been checked out of the facility by an unknown person and that after pickup, they noted their son was in pain and was crying. 

They further claim the next day, he was found to have a fractured femur and a healing fracture of his tibia. The plaintiffs allege that an investigation by the Arkansas State Police showed T.W.S suffered the injuries while at the defendant's daycare. They allege the defendants negligently concealed their son's prior physical abuse and failed to protect their son from child abuse by adequately supervising and training their staff. 

The Staggs seek monetary relief of more than $75,000, interest, trial by jury and all other just relief. They are represented by Justin Zachary, Joe Denton and Andrew Norwood of Denton & Zachary PLLC in Little Rock.
