Lawsuit: Boston Public Schools teacher assaulted 6-year-old

BOSTON (Legal Newsline) — A recently filed lawsuit alleges a teacher at a Boston school assaulted a student, causing him to fall down stairs.

S.D., individually and on behalf of her minor grandson, filed a complaint Sept. 26 in Suffolk County Superior Court against the City of Boston, Boston Public Schools and Ashley Bowman, alleging negligence and other claims. 

According to the plaintiff's complaint, her grandson J.D. was a six-year-old student at Higginson in Roxbury. She claims J.D. had "significant trauma history" and a behavioral support plan at the school. 

The plaintiff alleges on Jan. 13, 2022, Bowman, J.D.'s homeroom teacher, attempted to take away a bag he was holding and scratched him in the process. She further alleges Bowman shoved J.D. in the back while he was approaching stairs. The plaintiff claims Bowman falsely misrepresented that J.D. fell as he was running despite witness reports that he was pushed by Bowman. 

The plaintiff seeks monetary relief, interest, trial by jury and all other just relief. She is represented by Daniel Hefferman and Joseph Koltun of Kotin, Crabtree & Strong LLP in Newton.
