Lawsuit filed against Massachusetts after man's murder conviction overturned

BOSTON (Legal Newsline) — A man convicted of a 1984 murder who spent decades in prison is now suing the Commonwealth of Massachusetts for failing to turn over the evidence that exonerated him.

Albert Brown, otherwise known as Floyd Hamilton, filed a complaint Sept. 29 in Suffolk County Superior Court against the Commonwealth of Massachusetts, alleging wrongful conviction and other claims. 

According to this complaint, in May of 1987, Brown was convicted of first-degree murder and sentenced to life without parole and also convicted of armed robbery and sentenced to at least 35 years. He claims that three decades later, the post-conviction counsel for his co-defendant received discovery from the Suffolk County District Attorney's Office that included documents that were withheld and never previously disclosed to his defense team. 

Brown also claims that in October 2022, the Supreme Judicial Court granted him a new trial and in December of 2022, the murder and armed robbery charges were dismissed. He seeks damages for being falsely imprisoned.

Brown seeks more than $1 million, interest, trial by jury and all other just relief. He is represented by Paolo Corso and Frank Corso of Corso Law LLC in Rehoboth.
