BROOKLYN, N.Y. (Legal Newsline) — A New York class action lawyer alleges the presence of a synthetic ingredient in Wegmans' all-natural canned fruit.
Jonas Hernandez, individually and on behalf of all others similarly situated, filed a complaint Oct. 4 in the U.S. District Court for the Eastern District of New York against Wegmans Food Markets Inc., alleging violation of New York Business Law and other claims.
Hernandez, according to his class action, purchased Wegmans Canned Sliced Peaches and other of the defendant's canned fruit products from a store in Brooklyn. He claims the defendant misleads consumers by falsely representing the products are made "In 100% Juice Blend" and have no artificial colors, flavors and preservatives.
Hernandez alleges the products all contain ascorbic acid, a synthetic ingredient, and that the label creates a false "aura of healthiness" by its "food you feel good about" stamp on the label. He further alleges Wegmans sells a virtually identical canned fruit without ascorbic acid under a more expensive "organic" brand.
Hernandez and the class seek monetary relief, interest, trial by jury and all other just relief. They are represented by Adrian Gucovschi.
