Family sues Old Dominion after driver allegedly causes fatal crash

HOUSTON (Legal Newsline) — A family is suing Old Dominion Freight Lines after a driver carrying one of its loads allegedly sped through an intersection and caused a fatal crash. 

Angelica Farfan, individually and on behalf of the Estate of Eric Perez Escoto, deceased, and others filed a complaint  Sept. 15 in the U. S. District Court for the Southern District of Texas against Old Dominion Freight Line Inc., alleging negligence and other claims. 

According to the plaintiffs' complaint, Escoto was traveling on Spencer Road in Harris County on Dec. 6, 2022. They allege a vehicle carrying a load for Old Dominion failed to stop at a stop sign and continued speeding through the intersection. 

They further allege the defendant sped directly in front of Escoto and collided with his vehicle. According to the complaint, Escoto suffered fatal injuries from the impact of the crash. The plaintiffs allege the defendant's negligence for failing to train and supervise the driver and entrusting the driver with the load without exercising its retained control in a reasonable manner. 

The plaintiffs seek monetary relief, interest, trial by jury and all other just relief. They are represented by Clay Miller and Josh Birmingham of Miller Weisbrod Olesky LLP in Dallas.
