Lawsuit: Arby's overstates quality, portions of meat in sandwiches

NEW YORK (Legal Newsline) — Arby's is facing a class action lawsuit alleging it overstates the quality and portions of meat in its sandwiches. 

Joseph Alongis, on behalf of himself and all other similarly situated, filed a complaint Sept. 5 in the U.S. District Court for the Eastern District of New York against Arby's Restaurant Group Inc., alleging deceptive trade practices and other claims. 

Alongis alleges in his class action that Arby's is misleading consumers regarding the amount and quality of meat in their menu items. Specifically, Alongis claims Arby's misrepresents its roast beef sandwich in advertisements that show rare roast beef by positioning the sandwich with props so it appears to be larger in size, particularly its "Half Pound Beef and Cheddar" sandwich and Smokehouse Brisket. 

He claims Arby's materially overstates the amount and color of meat on in-store and drive-thru menu ordering boards as well on its website and food delivery service sites. He further claims Arby's is falsely promising a large portion of food to consumers who purchase the sandwiches in violation of the New York Deceptive Acts and Practices Act and that it breached its sales contracts with consumers who purchased an "Overstated Menu Item." 

Alongis and the class seek monetary relief, interest, trial by jury and all other just relief. They are represented by Anthony Russo, Jr., of The Russo Firm in Delray Beach, Florida.
