Class action: Kosher ice cream contains ingredients that causes bacterial illness

NEW YORK (Legal Newsline) — A class action lawsuit alleges Real Kosher Ice Cream does not disclose its products contain ingredients that increase risk of bacterial illnesses. 

Chaya Gurkov, individually on behalf of herself and all others similarly situated, filed a complaint  Aug. 14 in the U.S. District Court for the Eastern District of New York against Real Kosher Ice Cream Inc., alleging violation of New York General Business Law, breach of express of warranty and other claims. 

According to Gurkov's complaint, she purchased Real Kosher Ice Cream's sorbet and ice cream products. She claims that the products are misleadingly and deceptively labeled and marketed because the defendant does not disclose that the consumption of the products may increase the risk of contracting invasive infections. 

Specifically, Gurkov claims the products contain or are at the risk of containing Listeria monocytogenes, which the defendants do not list on the product's packing. She alleges the defendant falsely claims its products are "100% Natural" when they actually contain a synthetic ingredient extracted by breaking down seaweed. 

She further alleges consumers lack the meaningful ability to test or verify the products' substances, including the bacteria that causes Listeria.  

Gurkov and the class seek monetary relief, interest, trial by jury and all other just relief. They are represented by Jason Sultzer and Daniel Markowitz of The Sultzer Law Group PC in Poughkeepsie and Nick Suciua III of Millberg Coleman Bryson Phillips Grossman PLLC in Bloomfield, Illinois.
