BOWLING GREEN, Ky. (Legal Newsline) — A Kentucky woman who lost thousands of dollars by gambling through an online casino claims she is entitled to recovery of money according to state law.
Deborah Hobbs, on behalf of herself and all others similarly situated, filed a complaint Aug. 7 in the U.S. District Court for the Western District of Kentucky against Genesys Technology N.V., doing business as Jumba Bet alleging violation of Kentucky law.
According to Hobbs' class action complaint, the defendant owns the online casino Jumba Bet under the Funky Fortunes brand and offers games including slots and poker.. She claims she has gambled and lost thousands of dollars gambling on Jumbabet.com.
Hobbs says that by operating its online casinos, the defendant has violated Kentucky law and illegally profited from tens of thousands of consumers. She claims that once a user signs up and creates an account, they can deposit money that is instantly available for gambling and that all outcomes in the defendant's games are based entirely on chance.
Hobbs alleges that she and the class are entitled to recover any losses they suffered under the Commonwealth of Kentucky's "Recovery of money lost at gambling" statue.
Hobbs and the class seek monetary relief, interest, trial by jury and all other just relief. They are represented by Phillip Fairbanks and Bartley Hagerman of Mehr Fairbanks Trial Lawyers PLLC in Lexington and Phillip Fraietta, Alec Leslie, Matthew Diamond and Julian Diamond of Bursor & Fisher PA in New York City.
