Suit: Walmart's saltine crackers fraudulently labeled as 'Made With Whole Grain'

ORLANDO, Fla. (Legal Newsline) — A Florida woman alleges Walmart's Great Value brand saltine crackers are fraudulently labeled as having a significant amount of whole grains. 

Yadira Pagan, individually and on behalf of all others similarly situated, filed a complaint July 10 in the U.S. District Court for the Middle District of Florida against Walmart Inc., alleging violation of the Florida Deceptive Trade Practices Act and other claims. 

Pagan, according to her complaint, purchased Walmart's Great Value brand saltine crackers, which are labeled "Made With Whole Grain." She alleges that labeling the product as "Made With Whole Grain" but omitting the amount of whole grains per serving "relative to the recommended consumption" is misleading to consumers. 

Pagan further alleges that consumers believe they are consuming more whole grains than they really are and the addition of malted barley flour further deceives consumers because it adds a dark brown color to the crackers. She alleges that she and other consumers expect the crackers to be predominately whole grains when it does not contain a nutritionally significant source of whole grains or fiber.  

Pagan claims consumers paid more for the product due to the fraudulent labeling. 

Pagan and the class seek monetary relief of more than $5 million, interest and trial by jury. They are represented by  William Wright of The Wright Law Office PA in West Palm Beach, Florida and Spencer Sheehan of Sheehan & Associates PC in Great Neck, New York.
