Goodwill faces suit over 2022 data breach of employee, applicant personal information

BROOKLYN, N.Y. (Legal Newsline) — A former Goodwill employee and job applicant have filed a class action lawsuit over the company's 2022 data breach.

Wendy Booker and Francis Mascaro on behalf of themselves and all others similarly situated, filed a complaint June 26 in the U.S. District Court for the Eastern District of New York against Goodwill Industries of Greater New York and Northern New Jersey Inc., alleging negligence and other claims. 

According to the plaintiffs' complaint, Booker applied for a job with Goodwill approximately 25 years ago and Mascaro was employed by Goodwill from 2013 through July 2021. They allege that they have suffered damages from Goodwill's data breach that took place in October of 2022, and that they were not given notice of the data breach until more than seven months after its start. 

The plaintiffs claim that their personal identifiable information, including their names and Social Security numbers, were compromised, which puts them at risk of identity theft. They claim Goodwill's negligence for failing to implement industry-standard security procedures and failing to exercise reasonable care in handling their personal identifiable information. The plaintiffs also claim Goodwill failed to promptly detect attempts of unauthorized access to their data. 

The plaintiffs seek monetary relief, interest, trial by jury and all other just relief. They are represented by Illana Wolk of The Jacob D. Fuchsberg Law Firm LLP in New York City and Raina Borrelli of Turke & Strauss LLP in Madison, Wis.
