LOS ANGELES (Legal Newsline)— Consumers allege HexChad cookware is falsely marketed as non-toxic when it contains a chemicals known to cause health issues.
Khuschbu Didwania, Pratikkumar Patel and Bejamin Adams filed a complaint June 27 in the U.S. District Court for the Central District of California against HexChad Cookware Inc., alleging breach of express warranty and other claims.
The plaintiffs, who purchased HexChad Cookware products, allege the defendant is misleading consumers with its marketing of the cookware and falsely claiming the cookware is "non-toxic" and "free from" certain chemicals. They allege the defendant claims its cookware is free from PFOA and PFAS while also admitting the products are coated with polytetrafluoroethylene (PTFE) and marketing it as safe.
The plaintiffs claim PTFE is a chemical compound that contains carbon and fluorine which stays in the human body and been shown to cause cancer, endocrine disruption and other health concerns. They also claim the defendant falsely represents to consumers that PTFE is used in medical settings but fails to disclose in medical settings, the PTFE would not be heated to high temperatures like the cookware.
The plaintiffs allege they would have not purchased or would have paid less for the cookware if they had known the "true facts" about the cookware's safety claims.
The plaintiffs seek monetary relief, interest, trial by jury and all other just relief. They are represented by Caleb Marker of Zimmerman Reed LLP in Los Angeles, Brian Gudmundson and Rachel Tack of Zimmerman Reed LLP in Minneapolis and Christopher Jennings and Tyler Ewigleben of The Johnson Firm in Little Rock, Arkansas.
