Renter claims landlord's failure to fix leak caused mold infestation, children's respiratory issues

TALLAHASSEE, Fla. (Legal Newsline) — A renter alleges her children suffered upper respiratory issues due to mold growth in her Florida apartment. 

Meredith Plash, individually and as next of friend on behalf of Vanessa Russaw and Isabella Myles, filed a complaint June 2 in Leon County Circuit Court against BMG Tallahassee LLC and High Level Holdings LLC, alleging negligence and other claims. 

According to her complaint, Plash and her daughters moved into the defendants' apartment in April of 2018. She claims she immediately informed the landlords that there was a leak and requested maintenance. 

Plash further claims the pipe was fixed but began leaking again in December of 2019, with no response to her repeated maintenance requests. She alleges she contacted the local code enforcement and that the defendants sent a technician to repair the pipe but did nothing to remove the "excessive" moisture from her apartment. 

Plash claims her children suffered upper respiratory symptoms due to mold growth in the closets and on her belongings and that in April of 2020, she discovered another water leak from the ceiling. She also claims a mold assessment showed Cladosporium and penicillium growing in her children's bedroom. Plash alleges the defendants' negligence for failing to repair the underlying issues that caused the water and moisture intrusion. 

Plash seeks monetary relief, interest and all other just relief. She is represented by Attorney Scott Gelfand PA in Coral Springs, Florida.
