Lawsuit says pharmacy gave woman sedative by mistake, leading to car wreck

PARAGOULD, Ark. (Legal Newsline) — An Arkansas woman alleges a pharmacy gave her a sedative drug instead of her correct prescription, which caused her to fall asleep at the wheel of her car.

Amanda Walker filed a complaint May 30 in Greene County Circuit Court against City Drug Company, Joy Miller, Nikki Houston, Mallory Williams and John Does 1-3 alleging negligence and other claims. 

According to Walker's complaint, on May 26, 2021, she had City Drug fill her prescription. She claims that she was given the "highly-sedative drug" Clonazepam instead of what her doctor prescribed, which caused her to fall asleep while driving her vehicle. 

Walker alleges she suffered serious and permanent injuries and that her inability to stay awake and alert was due to being given the Clonazepam by mistake. She further alleges the pharmacists, technicians and employees were negligent in filling and administering her medication and that they admitted to her physician that she was given the wrong medication. 

She claims the defendants' negligence for failing to take safe guards and to check her prescription to prevent the error, which caused her to suffer bodily injury, mental anguish, lost wages and to incur medical expenses. 

Walker seeks monetary relief, interest and all other just relief. She is represented by Amanda Walker of The Hughes Law Firm PA in Jonesboro.
