SAN FRANCISCO (Legal Newsline) — A California man alleges Safeway and Albertsons grocery stores fraudulently raise prices of items on their buy one get one (BOGO) promotions.
Caleb Haley, individually and on behalf of all others similarly situated, filed a complaint June 7 in the U.S. District Court for the Northern District of California against Albertsons Companies Inc., and Safeway Inc., alleging violation of California's Consumer Legal Remedies Act and and other claims.
Haley alleges that Albertsons and Safeway routinely increased the regular retail price of items that were offered for BOGO. He claims the free product offers are not actually free because the defendants increase the price of the first unit of the product to cover the cost of the second.
Specifically, Haley claims that his most recent BOGO purchase at a Safeway in California was Ben & Jerry's ice cream which was sold to him for $7.49 for a 16 oz. tub and that the price for Safeway Club Members for the ice cream on the day before the BOGO promotion was $4 for the 16 oz. tub. He alleges the defendants' BOGO sales pricing is unlawful, fraudulent and misleading. Haley further alleges that he and the class members lost money as a result of BOGO prices for the grocery products.
Haley and the class seek monetary relief, interest, trial by jury and all other just relief. They are represented by Beth Terrell of The Terrell Marshall Law Group PLLC in Seattle and Sophia Rios of Berger Montague PC in San Diego.
