Fatal drunk-driving accident leads to lawsuit against Arkansas bar

FORT SMITH, Ark. (Legal Newsline) — An Arkansas inmate, a bar and others are facing a wrongful death claim from the estate of a man killed in a drunk-driving collision. 

Christina Kizer, individually and as Special Administratrix of the Estate of Willie P. Kizer, deceased, filed a complaint May. 22 in Sebastian County Circuit Court against Downtown Live Inc., doing business as Roosters on the Avenue, Alejandro Carrillo and others alleging dram shop liability, negligence, wrongful death and other claims. 

According to Kizer's complaint, Carrillo was served alcohol on April 26, 2022, at Rooster's and Tipsy's in Fort Smith. Specifically, the plaintiff alleges that Rooster's violated state law by selling and serving Carrillo seven Modelo beers, a mixed drink and three shots within a four-hour period. 

She futher alleges Tipsy's violated state law by serving Carrillo a Modelo beer and three mixed drinks within a one-hour period, which increased his level of intoxication. Kizer claims that within hours of leaving Rooster's, Carrillo drove drunk and struck 40-year-old Willie Kizer's vehicle and caused a fatal collision. Carrillo is currently incarcerated at the Arkansas Department of Correction's Ouachita River Correctional Unit in Malvern after pleading guilty

Kizer seeks monetary relief, interest and all other just relief. She is represented by Bryce Brewer and Meredith Moore of Rainwater, Holt & Sexton PA in Little Rock.
