Lawsuit: Party guest on yacht drank fatal dose of illegal drug

SAN FRANCISCO (Legal Newsline)— The organizers of a company yacht party are facing a lawsuit after a guest unknowingly drank a fatal dose of an illegal drug. 

Mark Kilian, as Personal Representative of the Estate of Nicholas Weber, deceased, filed a complaint April 24 in the San Francisco Superior Court against Sunrun Inc., Aidan Leavitt, Compass Yacht Corp., Susan Line CA, LLC and Does 1-56 alleging wrongful death and other claims. 

According to the plaintiffs' complaint, Weber, who was 24 years old at the time, was a "guest of honor" at the Wolf of Sunrun yacht party in Coronado, California, hosted by Leavitt. The plaintiff claims Leavitt chartered a yacht called the Susan through the Compass Yacht Corp., and that during the party, Weber drank a bottle of what he thought was water. 

Kilian alleges another party guest altered Weber's drink to contain a large amount of the drug gamma hydroxybutyrate (GHB). He further alleges Weber attempted to induce himself to vomit the substance and was found in the restroom unconscious. Kilian claims that Weber's unintentional drinking of the fatal amount of GHB and a delay in receiving medical attention resulted in Weber's death on Oct. 3, 2022. The plaintiff alleges Leavitt had a history of abusing drugs and promoting a culture of illegal drug use within the Sunrun network. 

The plaintiff seeks monetary relief, interest, trial by jury and all other just relief. He is represented by Frank Pitre, John Thyken, Andrew Britton, Kevin Durkin, Kevin Durkin,Tracy Brammeier  and James Pullos of Cotchett, Pitre & McCarthy LLP in San Francisco and The Clifford Law Offices in Chicago.
