San Francisco shopper says security guard at grocery store spit in his face

SAN FRANCISCO (Legal Newsline) —A man is alleging negligence against a San Francisco grocery store and a private security company after allegedly being beaten by a security guard.  

Shawn Scott filed a complaint April 24 in the San Francisco Superior Court against Grocery Outlet Inc., and Barrera Private Security Inc., alleging negligence.

According to Scott's complaint, he was in the checkout line at the Grocery Outlet Bargain Market on Bayshore Drive in San Francisco on April 3, 2022. He claims that a security guard began "speaking abrasively to him with no provocation," which then escalated into the guard lowering his mask and spitting on him. 

He further claims the security guard hit him and struck him with a metal baton on the legs and head 10 to 20 times. Scott alleges Grocery Outlet's negligence for knowing the guard's tendency toward aggressive behavior and that eight months earlier, he had filed a complaint with Barrera over the guard's behavior that resulted in the guard's revocation to carry a firearm. 

He also alleges Grocery Outlet's negligence for the hiring, training and supervision of the security guard. 

Scott seeks monetary relief, interest and all other just relief. He is represented by Arthur Lipton of The Lipton Law Office in San Francisco, California.
