Florida law firm accused of misplacing client's Workers' Compensation funds

TALLAHASSEE, Fla. (Legal Newsline) — A Florida law firm is facing a legal malpractice lawsuit after allegedly misplacing a client's Workers' Compensation claim settlement funds. 

Thomas Hall filed a complaint April 20 in the Leon County Circuit Court against Gus Soto and My Attorney Inc., doing business as The Soto Law Firm, alleging legal malpractice, fraud and other claims. 

According to Hall's complaint, he entered into a contract with The Soto Law Firm in June of 2020, for legal representation regarding a Workers' Compensation claim. He claims Soto failed to properly supervise his staff and manage a trust account in accordance with the rules regulating the Florida Bar Association. 

Specifically, Hall claims Soto received three checks in April of 2022, made out to the firm in the amount of $41,850, and two checks made to him for $100,000 and $20,650. He alleges that he received no further funds from the Soto Law Firm and was told by Soto that the remaining funds due to him had "vanished." Hall alleges Soto failed to provide adequate legal services and mishandled his case which caused him financial damage in the loss of funds to which he was entitled. 

Hall seeks monetary relief of more than $50,000, interest, trial by jury and all other just relief. He is represented by C. Garrett Gaa of Dismuke Law in Lakeland, Florida.
