Client alleges law firm's delay caused her to lose rights to injury claim

BOSTON (Legal Newsline) — A client alleges a Massachusetts law firm allowed work on her personal injury case to cease for a year, which caused her to lose her claim. 

Carolyn Jones filed a complaint March 7 in Suffolk County Superior Court against Christopher Earley and Earley Law Group alleging legal malpractice and other claims. 

According to the plaintiffs' complaint, Jones suffered serious injuries on Jan. 15, 2020, while riding a Massachusetts Bay Transportation Authority bus when the driver made an abrupt stop. They allege that on Jan. 24, 2020, Jones signed a fee agreement with Earley Law to represent her in the personal injury case. 

The plaintiff claims the defendants failed to perform any work on her case for a 12-month period throughout the 31-month representation. She further claims the defendants negligently managed Jones' case including failing to conduct an investigation and obtain evidence from the Massachusetts Bay Transportation Authority that allegedly included a video showing she was not injured. 

The plaintiffs allege the defendant also failed to obtain complete and accurate medical records and bills or properly present her claim to the Massachusetts Bay Transportation Authority. They allege the defendants' delays and actions caused Jones to lose the rights to her claims. 

The plaintiff seeks monetary relief, interest, trial by jury and all other just relief. She is represented by Neil Burns and Healther Zengilowski of Burns & Jain LLC in Boston.
