Suit: P&G fails to disclose Gain laundry detergent contains probable carcinogen

BUFFALO, N.Y. (Legal Newsline) — A consumer class action alleges Proctor & Gamble fails to disclose its Gain laundry detergent contains the toxin dioxane. 

Darlene Hagen-Hall, individually and on behalf of all others similarly situated, filed a complaint March 13 in the U.S. District Court for the Western District of New York against The Procter & Gamble Company, alleging breach of express warranty and other claims. 

The plaintiff alleges in her class action that Proctor & Gamble's Gain Laundry detergent is fraudulently packaged as representing "natural elements" such as flowers, leaves and butterflies yet contains high levels of the toxin dioxane. Specifically, the plaintiff claims independent testing discovered 3.32 parts per million of dioxane but nowhere on the detergent's package does it disclose the presence of the toxin, a probable human carcinogen which accumulates in the body. 

She also claims dioxane has been detected in drinking water as a result of the laundry detergent getting washed down the drain and into aquifers. The plaintiff alleges Procter & Gamble negligently misrepresented that its product was beneficial for the environment and benefited from its false claims. 

The plaintiff and the class seek monetary relief, interest, trial by jury and all other just relief. They are represented by Spencer Sheehan of Sheehan & Associates PC in Great Neck, New York.
