Consumer public interest group alleges food product contains bacteria

WASHINGTON (Legal Newsline) — A consumer public interest organization is claiming a popular "all-in-one" meal product contains harmful bacteria. 

Consumer Products Association (CPA) filed a complaint Jan. 30 in the Superior Court of the District of Columbia against 310 Nutrition LLC alleging violation of the District of Columbia Consumer Protection Procedures Act and other claims. The defendant recently removed the case to federal court.

According to the CPA, a public interest organization, 310 Nutrition is deceptively marketing its "Shake All-In One Meal" products. Specifically, the CPA claims in its class action that 310 Nutrition failed to warn consumers that its products contain the harmful bacteria bacillus cereus which is associated with human food poisoning. 

They further claim testing showed the presence of the bacteria in the 310 Nutrition products and that the defendant knew or should have known the bacteria was present and posed health risks.  The plaintiff alleges 310 Nutrition falsely represented its products were safe for consumption. 

CPA seeks monetary relief, interest, trial by jury and all other just relief. It is represented by Mohaimina Haque of The Law Office of Mohaimina Haque PLLC in D.C. and J. Nelson Happy of The Law Office of J Nelson Happy PLLC in D.C.
