Patient claims surgeon punctured aorta wall during abdominal procedure

MOUNTAIN HOME, Ark. (Legal Newsline) — An Arkansas woman claims a surgeon punctured her aorta wall during an abdominal procedure. 

Emma Mears filed a complaint Feb. 10 in Baxter County Circuit Court against John Spore, M.D., alleging negligence. 

According to Mears' complaint, she saw Spore at Baxter Regional Medical Center on Sept. 15, 2021, for pain in her abdomen. She claims Spore performed a diagnostic laparoscopy for a suspected appendicitis the following day and during the procedure, punctured the wall of her aorta. 

Mears further claims a vascular surgeon was called in to repair her injuries and an appendectomy was performed. She alleges that Spore's negligence from her initial surgery led to another hole in her aorta that was left unrepaired, internal bleeding and the requirement of subsequent surgeries to repair the damage. Mears also alleges she endured days in the hospital, lengthy rehabilitation and scars and now suffers panic attacks. She claims Spore failed to apply reasonable care and skill in performing her abdominal surgery. 

Mears seeks monetary relief, interest and all other just relief. She is represented by John Polewski of Polweski & Associates in DeSoto, Texas and Harold Cook and Whitney Cossio of Cook & Cossio in Little Rock.
