Nurse injured while helping victims of vehicle collision claims negligence

LITTLE ROCK, Ark. (Legal Newsline) — A nurse who was injured while trying to help victims of a vehicle collision on an interstate in Little Rock, Ark., is claiming negligence. 

Ashley Harvey filed a complaint Feb. 2 in Pulaski County Circuit Court against Marten Transport of Wisconsin LTD, Donald Ray Honeycutt, Tessah Deidre Hardin, Mike Willbank, Paula Willbank and others alleging negligence.

Harvey, a nurse, claims in her complaint that on May 16, 2020, she pulled off 1-40 near the Arkansas River bridge in Little Rock on a rainy night to help assist people in an overturned vehicle. She alleges she turned on her vehicle's hazard lights and that the area on the interstate had poor lighting. 

Harvey claims Hardin was driving a vehicle owned by the Willbanks and traveling on in the inside lane approaching the overturned vehicle as Honeycutt was traveling in the middle lane. She alleges their vehicles collided and struck the overturned vehicle and that the impact caused the overturned vehicle to turn counter-clock wise, strike her and cause her to suffer injuries. 

She alleges the defendants were driving too fast for the conditions, failed to keep a lookout for other vehicles, were driving too close to another vehicle and failed to pay attention to approaching hazards. Harvey claims she has suffered pain, mental anguish, lost earnings and incurred medical expenses. 

Harvey seeks monetary relief, interest, trial by jury and all other just relief. She is represented by Rob Beard of Rainwater, Holt & Sexton PA in Little Rock.
