Wrongful death lawsuit filed over worker's fall at 2022 U.S. Open

BOSTON (Legal Newsline) — The estate of a man who was a worker at the 2022 U.S. Open and suffered a fatal fall off a temporary platform is claiming negligence. 

Rochelle McConnell, as personal representative of the Estate of David McConnell, Jr., and David McConnell, Sr. as next of kin, filed a complaint Dec. 29 in the Massachusetts' Suffolk County Superior Court against The Country Club, United States Golf Association, Inc., and Munoz Labor Company alleging negligence and other claims. 

According to the plaintiffs' complaint, David McConnell, Jr., was employed to provide security at the U.S. Open held in Chestnut Hill, Mass., in June 2022. They claim that McConnell was working an overnight shift when he fell to his death on one of the temporary platforms that was set up for the tournament. 

The plaintiffs further claim McConnell's body was discovered by a co-worker in the morning, laying face down on top of a rock in a poncho that was still wet from the prior evening's rain. They allege the USGA was cited for OSHA violations including for a failure to have guardrail systems and a safety net and failure to properly train its employees. 

The plaintiffs claim McConnell was not provided any safety equipment and that the platform had no railings was negligently assembled and presented a hazard. They also claim the defendants failed to maintain and oversee the tournament equipment.

The plaintiffs seek monetary relief, interest, trial by jury and all other just relief. They are represented by Matthew Hanson and Adam Combies of Combies Hanson PC in Boston.
