Server settles suit against country club after alleging gender discrimination

SAN JOSE, Calif. (Legal Newsline) - A California woman who accused her employer of gender discrimination has settled her lawsuit.

Plaintiff Jomar Lacsina and the Almaden Golf and Country Club requested dismissal of her case on Oct. 12 in Santa Clara Superior Court, after having reached a confidential settlement.

Lacsina was hired by the country club as a server in 2016. She says she identifies as female and is a member of the LGBTQ+ community.

She says that an assistant manager discriminated against and harassed her for her gender identity and sexual orientation, using slurs and other offensive statements when speaking about her to others.

She was subjected to slurs like "fag" and "queer," she says, with the assistant manager also claiming to not known what "it is" when talking about her.

The plaintiff alleged that when she voiced a concern about tip withholding, her shifts were reduced until she was not scheduled to work at all. The country club allegedly did not pay Lacsina her last paycheck and didn't respond to her attempts to understand what happened to her employment.
