Suit: Pet nutritional supplements don't contain promised amount of ingredients

CHICAGO (Legal Newsline) — The maker of pet nutritional supplements is facing a class action lawsuit alleging its products to not contain the promised amount of ingredients and include harmful contaminants.  

Charles Carmen filed a complaint Oct. 9 in the U.S. District Court for the Northern District of Illinois against Zesty Paws LLC alleging violation of state consumer fraud acts, negligent misrepresentation  and other claims. 

Carmen alleges in the class action that Zesty Paws' makes false claims on its Vet Strength Mobility Bites, Hemp Elements Mobility Bites, Ancient Elements Mobility Bites, Core Elements Mobility Flavor Infusions, Multifunctional 8 -in-one Bites and Aller-Immune Bites pet nutritional supplement labels. Specifically, Carmen alleges the label on the Vet Strength Mobility Bites promotes that the supplement contains 100 mg of chondroitin sulfate when the product actually contains less than 2.5 mg or 2.5% less of the amount advertised, per independent laboratory analysis. 

He further claims the defendant's Aller-Immune Bites contain less than one thousandth of a percent of the promised probiotics than what is stated on the product's label. Carmen also alleges Zesty Paws claims its products are of high-quality ingredients and labeled with a "quality seal" when some contain harmful contaminants, also according to laboratory testing. He alleges Zesty Paws sells its products at a premium price while making false representations and omissions regarding its pet supplements. 

Carmen and the class seek monetary relief, interest, trial by jury and all other just relief. They are represented by Spencer Sheehan of Sheehan & Associates PC in Great Neck, New York.
