SAN FRANCISCO (Legal Newsline) - Confusion about caffeine has led to a class action lawsuit against the maker of Clif-brand Bloks energy chews.
Three plaintiffs filed suit against Clif Bar & Company on Aug. 26 in California federal court. They say the company's representation that the chews contain either 25 or 50 mg of caffeine, depending on flavor, lead consumers to think that much caffeine is in each chew.
"Defendant fortifies this perception because nowhere in the product's nutrition information and ingredients on the product's packaging does Defendant state the amount of caffeine per cube," the suit says.
However, it takes three cubes to reach that much caffeine, the suit says - a fact missing from the Clif website too. All Clif has to do is add the words "per serving" on the packaging, it says.
"Buried underneath a flap on the bottom of the product's packaging, Defendant purportedly includes a small print disclaimer in small font stating '3 CLIF BLOKS contain [25 mg or 50 mg] of caffeine.'"
