MIAMI (Legal Newsline) - Sherwin-Williams faces a class action lawsuit that alleges the prices it displays in its stores aren't accurate.
Luimy Cabreja filed suit July 13 in Florida federal court against the paint company, alleging the prices are boosted with a 4% supply chain charge that is added at checkout. The charge is never "reasonably disclosed" to customers until it shows up on their receipts after the purchase is complete, the suit says.
"Moreover, the 'supply chain charge' is itself a misnomer and a deception," the suit adds.
"Defendant knows full well that average consumers do not understand the meaning of the term 'supply chain' nor the indirect effect that economists understand it has on prices. Reasonable consumers are not economists."
The confusing name of the fee disguises Sherwin-Williams' real motivation for imposing it - to raise prices, the suit says.
Lawyers at Shamis & Gentile in Miami and Edelsberg Law in Aventura are representing the plaintiff.
