Class action says Dollar General pain relief patches won't stick to skin

CHICAGO (Legal Newsline) - Dollar General is facing a class action lawsuit that alleges its brand of lidocaine pain relief patches won't stick to users' bodies long enough.

Attorney Spencer Sheehan filed the suit June 29 in Chicago federal court, citing a 2021 study published in the Journal of Pain Research that found no generic lidocaine patch on the market fully sticks to the user's body for a full 12 hours.

Dollar General's packaging claims its patches are "maximum strength" and last up to 12 hours, the suit says.

"While certain companies innovated their technology based on clinical studies to ensure that their lidocaine patches reliably adhere to a consumer's body, even while exercising, upon information and belief, Defendant has not," the suit says.

"The claims that the product 'LASTS UP TO 12 HOURS' and is a 'Stay-put flexible patch' are misleading because it regularly peels off the bodies of users within a few hours, and often minutes, after being applied."
