Distribution of $50K from car wreck case in question

LAS VEGAS (Legal Newsline) - A Nevada personal injury law firm is going to court to make sure the proper parties get paid from its client's settlement.

Clark Law Group filed a complaint in interpleader in March in Clark County District Court, and the case was removed to Nevada federal court on April 22. The litigation stems from the firm's representation of Denise Henderson in a car accident case.

The case resulted in $50,000 in settlements, and Clark Law says it is entitled to one-third - $16,666.67.

"At this time, a dispute exists between Plaintiff and Denise concerning allocation and distribution of the settlement proceeds," the complaint says.

All claims made by interpleader defendants like American Medical Response and Southern Hills Hospital exceed $15,000, the law firm says.

"Plaintiff is not in a position to determine the fair distribution of the remaining settlement proceeds to the Interpleader Defendants after the distribution to Plaintiff," the firm wrote. "As such, it has become necessary to file this complaint in interpleader."
