SEATTLE (Legal Newsline) – Daytime cold and flu medicines from Amazon contain an ingredient that can make users drowsy, a new class action lawsuit alleges.
Lawyers at Phillips Law Firm, Milberg Coleman and Levi & Korsinsky filed the case the case April 22 against Amazon.com, claiming Basic Care brand medicines contain Dextromethorphan Hydrobromide.
The capsules’ packaging contains the words “Daytime” and “Non-Drowsy.” The suit alleges plaintiffs like Susan Fitzl became “unexpectedly drowsy” when using them.
“Plaintiffs and Class members purchased the Non-Drowsy Products with the expectation that the products would not cause drowsiness and that they were intended to be used during waking hours,” the suit says.
“Because Defendant sold products to consumers that cause drowsiness, Plaintiffs and the Classes were deprived of the benefit of their bargain.”
The suit seeks the certification of a nationwide class of consumers. If that isn’t granted, it seeks Wisconsin and Ohio classes.
