Sexual assault lawsuit blames Boston for victim's treatment at Boston Arts Academy

BOSTON (Legal Newsline) - The City of Boston faces a lawsuit over the alleged sexual assault of a Boston Arts Academy student at a Christmas party.

A Jane Doe sued the city on March 16 in Suffolk County Superior Court, also naming another student and his parents as defendants. The alleged assault occurred at a Christmas party at the parents' house in 2017.

The student "grabbed her breasts, dragged her upstairs to a bedroom where he ripped off her underpants and digitally penetrated her vagina, forcefully, and without her consent," the suit says.

Jane Doe was 16 years old at the time, and the parents were not home during the party. The students were unsupervised with free access to alcohol, the suit says.

She says her underpants were kept as a "trophy" and the student told others what he had done. She was sexually harassed and bullied afterward, she says, and she reported the assault to the school nurse in February 2018.

The following year, she says she told other teachers about it but they took no action to separate her from her assailant. She quit school, never graduated and was diagnosed with post-traumatic stress disorder in 2020, the suit says.
