Class action complains "fat bombs" aren't diet food

SAN DIEGO (Legal Newsline) - SlimFast is cheating consumers watching their weight with their chocolate snack cups called Keto Fat Bombs, a lawsuit alleges.

Lawyer Charles Weller filed a class action lawsuit on March 24 in San Diego federal court against SlimFast Foods Company, claiming snackers automatically think the claim "zero sugar" means something is a diet food.

He cites Food and Drug Administration regulations that states "Consumers may reasonably be expected to regard terms that represent the food contains no sugars or sweeteners... as indicating a product which is low in calories or significantly reduced in calories."

His lawsuit targets SlimFast's claim there is "zero added sugar" in its chocolate snack cups. The suit says they contain about the same amount of calories as Reese's Peanut Butter Cups.

It also complains the company's Keto Fat Bomb Shot has 100 calories and boasts to be "zero sugar."

"Because these products do not meet the regulatory definition (or any consumer's expectation of low- or reduced-calorie foods, federal regulations require Defendant to make a disclaimer that the products are not for weight control, or the like," the suit says.
