SAN FRANCISCO (Legal Newsline) - Clothing retailer Nordstrom finds itself the defendant in a lawsuit that claims it is selling a product that contains a chemical on California's Prop 65 list.
Ema Bell's March 14 lawsuit in San Francisco Superior Court says Nordstrom is violating Prop 65, which forbids the sale of products that contain chemicals the state considers carcinogens without a warning label, by selling materials with chemicals known as DEHP and BPA.
DEHP has been on the Prop 65 list since 1988 and BPA has been on it since 2015. Prop 65 allows for civil penalties of up to $2,500 per day per violation for up to $912,000.
The chemicals are allegedly in Felony Kaleidoscope iPhone cases, Cowshed travel sets; Janod toy shaving sets; Duchamp camo 2-in-1 tech + travel kits and Heron Preston camo iPhone covers.
"Each product was sent to a testing laboratory to determine the phthalate content of the product and/or to determine the concentration of BPA present on the surface of the product," the suit says.
"Plaintiff received from the analytical chemist an exposure assessment report for each product which concluded that persons in California who use the products will be exposed to levels of DEHP or BPA that require a Proposition 65 exposure warning."
